Sex racket case: court rejects revision plea

Says case pending in sub-court

KOZHIKODE: The District and Sessions Court has dismissed the revision petition filed by the Anweshi Women's Counselling Centre to array the former Industries Minister P.K. Kunhalikutty in the ice-cream parlour case.

The District and Sessions Judge Thomas P. Joseph, after hearing the arguments of the Anweshi counsel on Thursday, dismissed the revision plea on the ground that the case was pending in the Sub-Court, and hence it was not for this court to intervene in the case. The complainant could approach the appropriate forum with the contention, the court said.

The revision petition had been filed on the contention that since the name of Mr. Kunhalikutty appeared in seven places in the charge sheet, he ought to be included among the accused.

The Special Public Prosecutor K.V. Joseph, in his arguments before the II Additional Sub Court and Assistant Sessions Court, Kozhikode, argued that the name of Mr. Kunhalikutty be deleted from the charge sheet.

The Public Prosecutor had filed a petition before the court earlier, praying that the name of the former Minister ought to be deleted from the charge sheet. The argument was that both Supreme Court and High Court had examined the matter and given judgment on the same.

He pointed out that there were a number of deviations in the charge sheet. These must be amended. He said he found it difficult to carry the case forward under the circumstances. The judge K.P. Sudheer announced that the order on the petition will be pronounced on October 25.
