PATNA: Union Minister of State for Water Resources Jai Prakash Narain Yadav was on Saturday charged with getting his brother and RJD candidate from Jammui, Vijay Prakash, wrongly released from police custody.
`Abusing status'
A first information report, lodged by the Jammui police against Mr. Yadav, accused him of abusing his status and pressuring officials into getting his brother, booked under non-bailable sections, released. The FIR was filed after Mr. Prakash filed a case before the Chief Judicial Magistrate against Superintendent P. Arvind Kumar and some Special Task Force jawans, alleging murderous assault and arrest without proper reason. The matter would come up for hearing on November 14.
Others in FIR
Among others named in the FIR is the Khaira police station in-charge, Mukteshwar Prasad, who released Mr. Prakash on a personal bond. The police are seeking to re-arrest the RJD candidate, who is allegedly absconding, in the wake of the Election Commission's directive. The Government has received the Munger Commissioner's report on the incident. But officials maintained that any action against Mr. Yadav would be taken only after the submission of the investigation and supervision report.
BJP demand
BJP general secretary Arun Jaitley has demanded that Mr. Yadav surrender before the police, failing which the latter should arrest him. He said Prime Minister Manmohan Singh should dismiss him from his Cabinet for violating the poll process. Congress general secretary Digvijay Singh said the Jammui SP's action amounted to contempt of court as the Supreme Court had made it clear that no one should be beaten up in police custody. The issue would be fought legally.
