Kochi: A Division Bench of the Kerala High Court on Tuesday adjourned to October 28, the hearing on a writ petition seeking a directive to the State Government and the State Election Commission not to dissolve the Palakkad Municipal Council on the ground of the council's failure to elect a chairperson. The petition was filed by P.C. Krishnakumar and P. Sabu, BJP councillors, in the light of the recent developments in the Palakkad Municipal Council. The petitioners also sought a declaration that the deputy chairperson was entitled to discharge the functions of the chairperson in the absence of a chairperson. They also pleaded that action be taken against thee SC/ST councillors who failed to exercise their rights at the council meeting. According to the petitioners, the Election Commission had no power to dissolve the council under the provisions of the Kerala Municipalities Act. If it were dissolved, it would be an affront to the people and democracy. In fact, Section 64 of the Act empowered the Government to disband the council. As per the Section, it could be done only on the ground of the council's failure to approve budget, or financial crisis on the ground that majority members had been disqualified.
