City court allows petitions by Karunanidhi, Selvam

CHENNAI:
A city magistrate court on Tuesday allowed petitions by former Chief Minister M. Karunanidhi and Murasoli Editor S. Selvam, filed under Section 205 of the Cr.P.C. (Magistrate may dispense with personal attendance of accused) in a case against them, except during preliminary questioning, questioning under 313 of the Cr.P.C. and at the time of pronouncement of judgment.
After passing the order, XVIII Metropolitan Magistrate, Saidapet, K. Gayathri, adjourned the case to November 29. She said she would not allow any petition by the accused under Section 317 of the Cr.P.C seeking to dispense with their presence for the hearing on that date.
Copies of the charge sheet were received from the court by counsel for the accused.
The charge sheet has been filed against the DMK leader for an offence under section 295-A (Deliberate and malicious acts intended to outrage religious feelings of any class by insulting its religion or religious beliefs) of the IPC for writing an article in the Murasoli, which allegedly "outraged" the religious feelings of Hindus. The editor of the Tamil newspaper has also been cited as accused.
Both Mr. Karunanidhi and Mr. Selvam had filed petitions under section 205 of the Cr.P.C. After hearing arguments by defence counsel S. Ramasamy and prosecutor Jayaratnakumar, the Magistrate had earlier reserved orders.
When the case came up on Tuesday, the accused were not present. Petitions under section 317 of the Cr.P.C. were filed and were allowed.
