NEW DELHI: The Delhi High Court on Wednesday issued notices to the Delhi Government and the Delhi police on a petition challenging the legality of the Crime Against Women Cell (CAW). Justice R.C. Jain directed the two respondents to file replies to the petition by December 16. The petitioner, B.K. Agarwal, through his counsel K.C. Mittal submitted that the Cell had no legal authority to function and investigate in the absence of any legislation for that purpose. The police have no power to conduct a preliminary enquiry when no cognisable offence has been committed as held by the Supreme Court in the Bhajan Lal vs. State case, the petition stated. The Cell is supposed to give a copy of the complaint and follow principles of natural justice before investigation is carried out, but the copy of the complaint in his matter was not supplied despite requests made for the same.
