High Court pulls up MCD

For demolishing unauthorised constructions indiscriminately

NEW DELHI: Pulling up the Municipal Corporation of Delhi (MCD) for demolishing unauthorised constructions at West Patel Nagar in West Delhi indiscriminately, the Delhi High Court on Tuesday directed the local body to submit to it a list of builders whose building plans for constructing apartments in the colony it had approved between January 1, 2000, and January 1, 2005.

Directing the local body to submit the list by December 14, the next date of hearing, the Bench also asked it to suspend its demolition campaign in the area for three days to allow the violator property owners to remove their illegal constructions on their own.

The Bench passed this direction on an application by a group of unauthorised builders of the area submitting that the civic body instead of removing the illegal parts was demolishing the whole building.

However, the Bench made it clear to the local body that it was at liberty to resume the demolition if the violators failed to remove the unauthorised constructions on their own within the specified time period.

Observing that the builders had duped and committed fraud on the occupants of the apartments there in connivance with certain officials of the local body, the Bench said that the Court would fix the responsibility in the matter and order initiation of prosecution against the culprits.

Earlier, the MCD submitted a status report on the pulling down of unauthorised constructions in the area so far. However, the Bench observed that it was not satisfied with the report.
