Salem files petition in apex court
Legal Correspondent
New Delhi:
Extradited underworld don Abu Salem on Thursday moved the Supreme Court challenging an order of the Bombay High Court that quashed the TADA Court's order that only two police officers could interrogate him while in police custody. The gangster had filed a special leave petition (SLP).
The TADA court put restrictions on the Anti-Terrorist Squad on November 29, allowing only two officers, including the investigating officer, to interrogate Abu Salem.
This followed a plea by Abu Salem that several police officers were interrogating him, making him feel restless. On appeal by the Mumbai police, the Bombay High Court set aside the TADA court order. The SLP is likely to be mentioned tomorrow for early listing.
Abu Salem has contended in the SLP that the High Court had no jurisdiction to entertain an appeal from the Mumbai police against a TADA court order, as all appeals from the orders and judgments of the TADA court would lie only in the Supreme Court.
Great prejudice had been caused by the High Court reversing the TADA court order, he said and prayed for quashing the order.
