High Court Bench stays suspension of school teacher

Since the correspondent threatened to kill him, the petitioner lodged a complaint with the Saligramam police.

MADURAI: The Madurai Bench of the Madras High Court on Wednesday stayed the suspension order of a private higher secondary school teacher, who alleged that he was put on hold for lodging a criminal complaint against the head of the institution.

Usually, the Bench restrains from staying suspension orders, barring a few exceptions. However, in the present case, Justice D. Murugesan granted an interim stay since a prima facie case was made out for passing such an order.

The petitioner, K. Prabhakaran (33), working as a post-graduate assistant (zoology) in a higher secondary school at Suranam in Sivaganga district, said he joined the institution on June 3, 1999 on a consolidated pay of Rs.3000 per month. He had twice received the best teacher award from the District School Education Department.

But, on November 3, the correspondent of the school, along with three others, remonstrated with him for instigating higher secondary students to boycott classes against distributing low quality notebooks, the petitioner alleged. Since the correspondent threatened to kill him, the petitioner lodged a complaint with the Saligramam police.

On November 14, a show cause notice was issued to the petitioner calling for explanation as to why he should not be suspended from service and a detailed reply was filed.

The petitioner's counsel, G. Thalaimutharasu, said a complaint was also lodged with the Deputy Superintendent of Police, Protection of Civil Rights wing in Sivaganga, and after a preliminary enquiry the police registered the complaint under the Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, and other provisions of Indian Penal Code. Hence, the correspondent suspended the petitioner on November 20, the counsel added.
