Court orders re-employment of retrenched workmen

CHENNAI
: The Madras High Court has directed the State Government to re-employ over 75 bus drivers and conductors who were relieved from service even though they had completed 240 working days after being recruited by following due selection process.
Allowing a large batch of writ petitions and appeals, a Division Bench comprising Justice P. Sathasivam and Justice S.K. Krishnan categorically stated that an employer was bound to give an opportunity to the retrenched workmen to offer themselves for re-employment. "If the retrenched workmen offer themselves for re-employment, the employer is bound to give preference to them over other persons."
The matter relates to the dismissal of more than 75 bus drivers who were recruited through the employment exchange during March 2001. They underwent the selection process, were sent for training and then were appointed on consolidated wages before being made daily rated workmen. On completion of 240 working days, they were made permanent by two orders issued in January and March 2003.
