NEW DELHI: The Delhi High Court on Thursday issued a notice to the Delhi Development Authority (DDA) on petitions by four private schools here whose land leases the Authority had cancelled on Wednesday, holding them guilty of not providing free education to poor students in keeping with the land lease agreements. A Division Bench of the Court comprising Justice Vijender Jain and Justice Rekha Sharma asked the Authority to file a reply to the petitions next Monday. However, the Bench refused to stay operation of the lease cancellation orders observing that the schools were not going to be taken into physical possession by the next date. In their separate petitions, the four schools -- Pinnacle (Babs Naronha Educational Society), D-Block, Panchsheel Enclave; Gyan Mandir Education Society, Naraina Vihar; Rukmani Devi (Seth Pokhar Mal Education Society), CD Block Pitampura; and Bal Bharti School (Child Education Society), Pitampura -- alleged that DDA's action was arbitrary and unlawful. They also sought an interim stay on orders submitting that they apprehended that their schools would be taken into physical possession. In its orders , DDA had said that it had directed the authorities to take into physical possession of the sites under the Public Premises Eviction Act.
