Swamy ordered to pay compensation

New Delhi: The Delhi High Court on Tuesday ordered the former Union Minister and Janata Party leader Subramanian Swamy to pay a compensation of Rs. five lakh to criminal lawyer Ram Jethmalani for defaming the latter by charging him with having links with the LTTE in the wake of the Rajiv Gandhi assassination case. Noting that the defendant (Swamy) refused to apologise or withdraw his offending statements, Justice Pradeep Nandrajog, observed that ``a statement against a person that he has been receiving money from LTTE is ex-facie defamatory.''

During the inquiry by the M.C. Jain Commission of Inquiry to probe the circumstances leading to the assassination of the former Prime Minister Rajiv Gandhi, Dr. Swamy made certain statements before the panel that Mr. Ram Jethmalani, had received money from the LTTE for taking up cases on behalf of the banned organisation.

At that time Mr. Jethmalani was defending the Tamil Nadu Chief Minister Jayalalithaa, who was also accused by Dr. Swamy of having prior information about the impending killing of Rajiv Gandhi. — PTI
