Case against promoting head constables as sub-inspectors


Notice ordered to the Home Secretary and DGP Petitioner cites discrepancies in promoting 1984-batch mates Many eligible constables left out of promotion list

MADURAI: A writ petition has been moved before the Madurai Bench of the Madras High Court to restrain the police department from proceeding with the process of promoting head constables to the rank of sub-inspectors in all the ranges throughout the State.

Admitting the petition moved by a head constable attached to the Madurai city range, Justice S. Rajeswaran on Friday ordered to withhold the results of the examinations for promotion until the disposal of the case and issued notice to the Home Secretary and the Director General of Police.

The Madurai City Commissioner of Police was also directed to consider permitting the petitioner to appear for examinations scheduled between January 18 and 23.

Two sessions

The petitioner, M. Jeyaraj (43) said, he was one among thousands selected for the post of Grade II police constable in the recruitment drive conducted in 1984. Though the selection was made under the same proceedings, successful candidates were sent for training in two sessions — on August 1, 1984 and October 25, 1984.

The Government, in 1995, decided to promote Grade II constables to Grade I constables and the cut off date for the promotion was fixed as August 31, 1984. Hence, their batch mates who completed the training in the first session were elevated and the second group was left behind and promoted only two years later, in 1997.

Similarly, subsequent promotions were also delayed for candidates, who underwent training in the second session, though they were placed in equal footing with their counterparts who underwent training in the first session. Hence, the petitioner and others preferred a representation to the Director General of Police.

The Commissioner of Police in his communication dated August 4, 2005, addressed to the petitioner, said the representations were forwarded by the DGP to the Government and they were under active consideration.

But, in the meantime pursuant to the directions of the DGP, the Commissioner on January 2 this year had constituted a city range promotion board for promotion to the rank of sub-inspectors and also prepared a list of eligible candidates. Though the names of his batch mates who underwent training in the first session were included in the list, the petitioner and others were left out since they received their earlier promotions belatedly.
