NEW DELHI: A sessions court on Saturday awarded ten years rigorous imprisonment to a tutor who lured away 17-year-old neighbour student to Bihar and kept her in captivity for two months after forcing her to marry him. Handing down punishment to Prabhat Kumar Vidyarthi, 40, Additional Sessions Judge J M Malik said, ``it is crystal clear that the convict had misused the trust imposed on him and it does not behove on the part of teacher to run away with his student.'' The court also slapped a fine of Rs.10,000 on Vidyarthi after finding him guilty under Section 363 (kidnapping) and 366 (compelling woman to marry) of the IPC. However, the court acquitted the convict from the charges of rape as the victim refused to undergo medical tests. But, the ASJ was of the view that there was illicit relations between the victim and Vidyarthi. Victim, who was preparing for the 10th standard CBSE board examination, used to take tuitions from her neighbour in the Jagatpuri area of East Delhi. On the evening of October 8, 2002, when the victim did not return home, her anxious parents informed the police suspecting her teacher of having kidnapped her. The accused, though forcibily, married the victim after taking her to his home in Rohatash district of Bihar. Two months later, police recovered the girl from the house of accused. Vidyarthi, who was in jail there in connection with another case, was produced before this court for facing the trial. PTI
