BANGALORE: Manipal Academy of Higher Education (MAHE), a deemed university, has challenged notifications by the State Government and the Rajiv Gandhi University of Health Sciences (RGUHS) allotting students to postgraduate courses in its institution by conducting an entrance examination. In its petition, the academy said it was made a deemed university in 1993. On December 21, 2005 the State Government issued an order regulating admission to postgraduate medical and dental courses in private professional colleges. The GO entrusted the RGUHS the job of conducting the entrance examination for the postgraduate courses. On December 22, the RGUHS passed an order on the conduct of the postgraduate tests and on December 25, it invited applications from candidates for the test. The academy challenged the notifications by both the State Government and the RGUHS, contending that it was illegal and arbitrary. It said the test was slated for January 12 and this action was causing confusion among the students.
`No authority'
It said the Government had no authority to either regulate or in any way interfere with the process of selection of candidates or their admission by deemed universities. The academy prayed to the court to restrain the RGUHS from allotting any candidate to postgraduate or diploma courses and also quash the December 21 and December 22 notifications.
Upheld
A Division Bench comprising Justice S.R. Bannurmath and Justice N. Ananda on Monday upheld the order of a lower court in sentencing a person to life imprisonment and acquitting two others. While the State had appealed against an order of the Bagalkot District and Sessions Judge acquitting Dongrisab and Mahabub, both from Bilgi taluk, the first accused, Rafiksab also from Bilgi taluk, had appealed against his conviction. The Bagalkot court had sentenced Rafiksab to life imprisonment and acquitted Dongrisab and Mahabub on charges of murdering Arjun. The Division Bench confirmed the sentence on Rafiksab.
