Last date for power disputes settlement extended

Chandigarh: The Haryana Power Distribution Corporations (DHBVN and UHBVN) have decided to extend the last date for the on-going scheme for an out of court settlement of disputes pending in courts to February 15, 2006.

A spokesman for the Nigams said here on Sunday this scheme was launched in middle of October last to avoid prolonged litigation and to settle long pending court or arbitration cases.

The Haryana Power Distribution Corporations have offered this settlement scheme to its all consumers of domestic, non-domestic, industrial, agriculture and bulk supply categories to get their cases settled out of court.

The spokesman said the scheme would be available to all disputes (except theft cases booked under new Electricity Act) pending in courts including District Consumer Dispute Redressal Forum, State Commission or arbitration ending August, 2005 and still pending on date of settlement where penalties had been levied.

The scheme would not be applicable to the cases where amount had been charged after ascertaining the date of slowness of meter as load date or where disputes were on account of applicability of multiplying factor and to the cases where 100 per cent payment had been made by the consumer. The spokesman said that in cases where unauthorised load detected resulted in change of category, LT surcharge at the prescribed rate of 25 per cent of sale of power shall be payable in addition to the amount charged for out of court settlement. -- UNI
