Neera Yadav's plea in Noida case rejected

Court dismisses criminal revision petitions


Allahabad: The Allahabad High Court on Tuesday dismissed the petitions of former Uttar Pradesh Chief Secretary Neera Yadav and others challenging the criminal proceedings against for alleged irregularities in allotment of land in Noida.

A division bench of Chief Justice A. N. Ray and Justice Ashok Bhusan dismissed the criminal revision petitions, using the inherent power vested in high courts under Section 482 of the Criminal Procedure Code.

It said a full bench of the court had ruled that there was no need for a second sanction under section 197 of Cr PC to prosecute a Government employee if it had already been passed under Section 19 of the Prevention of Corruption Act, which had been done by the investigating agency CBI and the Central government.

Ms. Yadav and three others had challenged the proceedings pending before a designated CBI court in Ghaziabad as also the agency's chargesheet on the ground that prior approval of State Government under section 197 of Cr PC was not obtained.

Their petitions contended that entire proceedings were, therefore, illegal and liable to be quashed.

The CBI has submitted its chargesheet against Ms.Yadav and others for irregularities in allotment of land at Noida. PTI
