NEW DELHI: The Supreme Court on Friday directed the Delhi High Court to appoint presiding officers (not out of the existing strength) for special courts to settle disputes between the power distribution companies in Delhi and consumers and directed the State to see that court buildings are complete before the year-end and the courts start functioning by the end of 2006. The special courts are to be set up in Vikaspuri, Rohini, Wazirpur Industrial area, Malviya Nagar and Patpar Ganj Industrial area. The bench comprising Justice Rumapal and Mr Justice A R Lakshmanan and Mr Justice Dalveer Bhandari granted two weeks' time to the State government to file an affidavit detailing the steps being taken to step up power production Capital to meet the rising demand during summer. The issue of lack of police protection to the field staff of the distribution companies to detect and book power theft cases also came up for hearing and the court referred to its order dated November 29, 2004, for providing adequate security to the field staff of these companies to which the Delhi police had responded by saying that the matter was under consideration of law department of Delhi Police. Under section 151 of Delhi Electricity Act the offence of power theft is not cognisable and therefore the police can not take any action against the culprits. Counsel for the discoms said that police was pressing for written complaint before taking any action against the culprits while on the spot action was a must against the offenders. -- UNI
