NEW DELHI: The Supreme Court on Monday took suo motu cognisance of a 70-year-old man languishing in prison for 38 years without his case being sent to court for trial. A Bench of Chief Justice Y.K. Sabharwal and Justice C.K. Thakker, while taking cognisance of reports appearing in newspapers on Monday, ordered notice to the Uttar Pradesh Government. According to the reports, Jagjivan Ram Yadav of Faizabad district spent 38 years in jail as the trial court could neither grant him bail nor expeditiously take up charges against him for trial because no records existed. Jagjivan remained anonymous since he allegedly killed his neighbour's wife in 1968. His case resurfaced on July 5, 2005 at the district jail. The prison authorities sought a directive from the court about Jagjivan's status as an under-trial. The Additional Sessions Judge, Faizabad, Lal Chandra Tripathi, before whom he was produced, sought records from the Khandaga police station, where the case against him was registered. The police replied stating their inability to provide full details of the case.
