Kochi: Ernakulam Additional Chief Judicial Magistrate T.K. Madhu on Tuesday held that no special permission from the Court was needed to conduct a narcoanalysis test on Rojo, a suspect in the case relating to the missing of a seven-year-old boy from Alappuzha. The Magistrate, while disposing of a petition filed by the CBI seeking permission of the Court, said the filing of this type of plea would only delay the investigation. The Court said nobody could stand in the way of the investigation agency conducting recognised tests for effective investigation. Rahul was reported missing on May 18, 2005. He was last seen by his friends at a public tap for drinking water. The Magistrate said that going by the High Court judgment ordering a CBI investigation into the case, it could be seen that the investigation agency could adopt any modern scientific method for investigation. Besides, it was reported that the CBI had already subjected the suspect to brain mapping test and polygraph test, for which the CBI had not sought any prior-permission, the Magistrate added. In his petition objecting to the CBI's request, Rojo had said that a slight difference in the administration of the drugs on the subject could result in the persons lapsing into coma or cause his death. The CBI had sought permission of the Court, as it was not prepared to take up the responsibility for the adverse effect on the person concerned.
