Kochi: The Kerala High Court on Tuesday dismissed a writ petition seeking a direction to the State Government to work out the 10 per cent seat reservation for candidates from Scheduled Castes/ Scheduled Tribes in the medical postgraduate courses with reference to the entire seats available in the medical colleges in the State. Justice K. Balakrishnan Nair, while upholding the Government decision to allot 10 per cent of seats in the State quota, observed that the Government had a duty only to provide reservation in seats available with it. The Court said that if no reservation was provided in the All India Quota, the petitioner might move the Union of India or the Director General of Health Services. The petition was filed by 11 doctors belonging to the SC/STs.
Afghan national's bail
Justice K. Padmanabhan Nair ordered that bail could be granted to Jumarkhan, an Afghan national arrested for possessing fake passport, provided the Embassy of Islamic Republic of Afghanistan arranged an Indian national as surety. He was arrested on July 21, 2005 when he landed at Thiruvananthapuram airport. He was deported from Doha for travelling on a fake passport. The Session's Court had granted him bail on certain conditions. One of the conditions was that an Indian national who had previous acquaintance with the arrested should stand as surety for him. The High Court order came on the petition filed by the Afghan national.
Interest on ESI amount
Justice S. Siri Jagan has directed the Employees State Insurance Corporation (ESI) to pay interest on the dependant benefits due to the legal heirs of late T.V. Paulo, a former employee of the Premier Cables Company, Karukutty. The interest should be given at the annual rate of 6 per cent within two months. The petition was filed seeking interest for the dependants' benefits payable to the wife and children of the late employee. Criticising the ESI, the Court observed that an organisation which had been constituted and which proclaimed itself to stand for the betterment of the working class, had chosen to drag the poor petitioners in a litigation up to the Supreme Court.
