Apex Court's notice to Centre, EC

New Delhi:
The Supreme Court on Friday issued notice to the Government and the Election Commission on a petition that challenged the Constitutional validity of a provision in the Representation of the People Act under which a person would not be disqualified from being a member of a Legislature or Parliament after his or her conviction in a criminal case.
A three-member Bench, comprising Chief Justice Y.K. Sabharwal, Justices C.K. Thakker and R.V. Raveendran, issued the notice on the petition filed by advocate Vasant Kumar Chaudhary, who contended that Section 8 (4) of the RP Act, 1951 was ultra vires the Constitution.
