BMP appeals against single judge order on hoardings

BANGALORE:
The Bangalore Mahanagara Palike (BMP) has filed an appeal against a single judge order on advertisement hoardings and signboards.
The single judge had allowed a petition by an advertising agency, which had challenged the rejection by the BMP its proposal to put up a hoarding on a building on Dispensary Road.
The BMP had rejected the proposal for putting up the hoarding, saying that it was planned to be installed on the second floor and that it was coming up in an area which witnessed heavy traffic.
It had said that the hoarding, if permitted, would lead to visual pollution.
The single judge had allowed the petition, saying that the BMP endorsement to the firm that hoardings must not be more than 30 metres in height from the ground level was erroneous.
In its appeal, the BMP said bylaw 9 (a) specifically mentioned that the hoardings must not be more than 30 metres in height and that the hoardings should not project beyond the general line of the building.
A Division Bench comprising Chief Justice, Cyriac Joseph and Justice K. Sreedhar Rao admitted the appeal and adjourned further hearing on the case.
