Kochi: A Division Bench of the Kerala High Court on Thursday reserved its judgment on a writ petition challenging the Election Commission's power to enforce the model code of conduct even before the issue of official notification announcing the elections under Section 15 of the Representation of People's Act 1951. The petition, filed by K.M. Babu, general secretary of Kerala Non-Gazetted Officers Association, also sought a declaration that it was open to the State Government to implement the Ninth Pay Commission Report for Government employees, as the code of conduct would come into effect only after the election notification was issued. In a reply affidavit, the petitioner said the stand of the Election Commission that implementation of the Pay Commission report would influence the voters had no basis.
Noise pollution
A Bench comprising Chief Justice V.K. Bali and Justice J.B. Koshy issued notice to the State pollution control board and other respondents on a writ petition directing the Kerala State Pollution Control Board to give sufficient help to officers of the State Government who were implementing the Noise Pollution (Regulation and Control) Rules, 2000 for measuring the noise levels and for prosecuting them in accordance with law.
The petition was filed by the Public Interest Forum, Thrissur.
Justice K.K. Dinesan has directed the Cochin Devawom Board to consider the reply filed by the president and secretary of the Thiruvairanikulam Maha Deva Kshethra Trust in Aluva, in response to a show-cause notice after affording an opportunity of substantiating their contentions. The show-cause notice was issued to the president and secretary, alleging irregularities in the management of the temple.
