NEW DELHI: The Delhi High Court on Friday allowed Maninder Singh Kohli, facing extradition proceedings for deportation to Britain to face trial in the Hannah Foster murder case, to produce his wife as a defence witness for recording her evidence in the proceedings. Justice R.C. Jain directed Kohli's wife Shailender Kaur to file an application in an Additional Chief Metropolitan Magistrate (ACMM) court seeking permission to appear as a defence witness in the proceedings. The whole proceedings for recording of Kaur's evidence should be completed within a month from the date of the judgment. Mr. Justice Jain passed the judgment on a writ petition by Kohli. He had approached the High Court against the ACMM court's judgment dismissing his application seeking permission for his wife and eight others to depose in the proceedings. However, Mr. Justice disallowed Kohli's plea to allow the eight other witnesses to record their evidence in the matter. The Union Government through its counsel A.K. Vali along with N.K. Matta had opposed Kohli's application submitting that it was an attempt on the part of the accused to create obstructions and delay the proceedings. Mr. Vali submitted that in the on-going proceedings, the court had limited job to see whether a prima facie case for extraditing of Kohli to Britain existed or not.
