Admission to medical courses: clause in prospectus quashed

Kochi: A Division Bench of the Kerala High Court on Wednesday set aside the clause IV (b) in the prospectus of the postgraduate degree/diploma medical courses, which stipulated that those who apply for admission to the courses in medical colleges located in the State should have domiciled in the State for eight years.

The Bench, comprising Chief Justice V.K. Bali and Justice J.B. Koshy, quashed the clause in the prospectus issued by the Directorate of Medical Education as it found that the clause violated Article 14 (equality before law) and Article 16 (prohibition of discrimination on grounds of religion, race, caste, sex or place of birth).

The court passed the judgment on Wednesday while allowing writ appeals filed by some doctors against a single judge's order dismissing their writ petition challenging the clause.

Unauthorised buildings

The Bench, while disposing of a writ petition filed by the Institute of Social Science and others, held that while regularising unauthorised buildings that were constructed before 1999, the order should be passed after taking into consideration factors such as public safety and public convenience.

The judges upheld the Kerala Building (Regularisation of Unauthorised Construction and Land Development) Rules.

Directive to Pollution Control Board

Acting on another petition, the Bench directed the State Pollution Control Board to inspect the areas near Kerala Mineral and Metals Ltd. at Chavara and check whether the company was causing water and air pollution in the region.

If pollution was detected, the company should be directed to rectify the defects, the Bench directed..

The directives were passed on a petition filed by Neethi, Kollam.

The petitiotioner had complained that air and water pollution caused by the company at Panmana and Chavara in Kollam district were putting the people to much hardship.
