Writ plea against land acquisition

Kochi: A writ petition was filed before the Kerala High Court on Tuesday challenging the decision to transfer the land acquired for Infopark at Kakkanad in Kochi to Dubai Internet City for establishing Smart City there. According to petitioners M. N. Kochu Muhammed and others, the `Infoparks Kerala' was not an instrumentality of the State; in fact, it was a society. The Government was not empowered to delegate its functions to form a society. It was against Article 154 of the Constitution (executive power of the State). If the society wanted to acquire any property, it had to follow the procedure prescribed for acquiring land under the Kerala Land Acquisition Act. They also said that the transfer of land (acquired for a Kinfra project) to the `Infoparks Kerala' was illegal and arbitrary. The allotment of buildings constructed in the acquired property to Dubai Internet City was arbitrary.
