BANGALORE: The Karnataka Administrative Tribunal (KAT) has set aside the regularisation of the services of graduate literate assistants and literate mazdoors as first division assistants (FDAs) and directed the authorities to regularise them as second division assistants (SDAs). A Division Bench comprising KAT Chairman A.V. Srinivasa Reddy and Administrative member P. Kotalinganagoud allowed an application by Rao Saheb Sengappa and others, and set aside the regularisation of the services of P. Shivabasappa and S.B. Hanumesh, graduate literate assistants/literate mazdoors, in the Department of Forests as FDAs. The Bench said the regularisation of the two persons as graduate literate assistants was based on their qualification. It said graduation did not make a candidate eligible for regularisation of services as an FDA. Graduates could be regularised only as SDAs. The applicants Sengappa and others and the respondents Shivabasappa and Hanumesh were working as literate mazdoors under the daily wage category. .
Quashed
A Division Bench of the KAT comprising Mr. Srinivasa Reddy and Mr. Kotalinganagoud set aside a notification by the Karnataka Public Service Commission (KPSC) for recruiting a lecturer in Ceramics. Mariswamy, a member of a Scheduled Caste who holds a second-class BE degree in Ceramics, was an applicant. In its notification of January 4, 2003, the KPSC prescribed a first class in Ceramics as the minimum qualification for appointment as lecturer in the Department of Technical Education. The Bench quashed the notification as far as the candidate was concerned and directed the respondents to consider the selection and appointment of the applicant as a lecturer in Ceramics.
