BANGALORE: The Karnataka Administrative Tribunal (KAT) has set aside a penalty imposed by the authorities on an assistant sub-inspector (ASI) of Chintamani town police, Kolar district, and said the punishment was not in accordance with the Karnataka Civil Services (KCS) Rules. The ASI, P. Subramanyam, was retired from service for having allegedly accepted a bribe of Rs. 500.
Modified
The penalty of compulsory retirement was modified, and his pay was fixed at a lower scale. The KAT found that mandatory provisions under Rule 59 of the KCS rules were not followed.
Application allowed
A Division Bench of the tribunal, comprising its Chairman, A.V. Srinivasa Reddy, and Administrative Member, P. Kotalinganagoud, allowed an application by Mr. Subramanyam and observed that the disciplinary authority, which was vested with the power of imposing a penalty to reduce pay, should decide the date and period from which the lower pay scale would come into effect and other aspects, such as whether the person would be eligible for increments during the period of punishment. The Bench said the order of penalty of January 17, 1997, suffered from legal infirmities, and the provisions of Rule 58 of the KCS Rules were not followed.
Direction to respondents
It directed the respondents the State, the Deputy Inspector-General of Police, Central Range, and the Superintendent of Police, Kolar to grant the ASI service and monetary benefits within three months of receipt of its order.
