Court seeks status of NBW issued against Bharti Yadav

`She shifted to London to avoid recording of her statement'

NEW DELHI: A Delhi court on Thursday summoned in person a Union Home Ministry official to inform it about the status of a non-bailable arrest warrant (NBW) issued against former Rajya Sabha Member D.P. Yadav's daughter Bharti Yadav in the Nitish Katara murder case.

Additional Sessions Judge Ravinder Kaur summoned the official, Ramesh Kumar, an Under Secretary in the Ministry, along with the status report about the execution of the NBW issued by the court on March 7 for April 27.

Mr. Kumar is the official dealing with the task of serving the NBW on Ms. Bharti whose passport was recently revoked by the Ministry of External Affairs.

Immediately after the incident in February 2001, Ms. Bharti had moved to London and enrolled herself there in a professional institute.

However, the prosecution charge against her has been that she had shifted to London to avoid recording of her statement in the case.

`Execute arrest warrant'

In its March 7 order, the trial court had directed the Union Home and the External Affairs Ministries to execute the arrest warrant.

The trial court had last year allowed the prosecution to drop Ms. Bharti as a witness in the case when the Public Prosecutor submitted that the witness could not be produced for evidence as the London police were not ready to help in the matter on the ground that there was no criminal case pending against her there.

Revision petition filed

However, on a revision petition filed by Neelam Katara, mother of Nitish Katara, the Delhi High Court had set aside the lower court judgment and directed it to take all possible steps under the law to ensure the appearance of Ms. Bharti to record her evidence.

The prosecution's allegation against Vikas Yadav and his cousin Vishal Yadav is that they had abducted and later killed Nitish Katara, son of a former senior IAS officer (since dead) here, as they were against Nitish having an affair with Ms. Bharti.
