DoTE order stayed by Madras High Court

CHENNAI: An order from the Directorate of Technical Education, which resulted in the transfer of some students of the Deen Dayal Engineering College to another college has been stayed by the Madras High Court.

Justice D. Murugesan passed the order on a writ petition filed by the college chairman, T.D. Naidu, challenging the order of the Commissioner of Technical Education. Claiming that the college management had warned some senior students of expulsion after they were found ragging juniors, the petitioner said the All India Council for Technical Education and the Anna University had not acceded to the transfer plea of those students.

However, the Directorate of Technical Education issued the impugned order despite it not having any jurisdiction in such matters. "The power to transfer students from one approved institution to another vests only with the AICTE," he said, adding that in June 2003, the Council had sent a circular to the State Government asking it not to take any "unilateral" decision on AICTE-approved institutions with respect to student intake and transfer of students. The Council has an exclusive Malpractices Prevention Cell for the purpose, it said.

The petitioner-institution was not issued a show-cause notice or was given an opportunity to explain the matter.
