NEW DELHI: The Delhi High Court has imposed a fine of Rs. 25,000 on the Secretary (Land Acquisition) of the Delhi Government for acquiring a piece of land along with the house built on it without following established procedure at Nagal Raya village in South-West Delhi in November 2004. Holding the Secretary guilty of acquiring the land along with the house and then demolishing it to build a school without following the procedure laid down under Section 4 of the Land Acquisition Act, Mr. Justice Nandrajog directed the State Government to recover the fine amount from the salary of the official and make adverse entries in his service record. The Court also suggested to the owner of the land to file a suit for damages for acquiring his land without following the established procedure.
In his petition, the landowner submitted that in November 2004 the Delhi Government and the Delhi Development Authority (DDA) had acquired his land measuring 130 square yards
