MUMBAI: The trial in the perjury case against Zahira Sheikh and her family will begin on Wednesday in the court of additional sessions judge Abhay Thipsay. On Tuesday, Zahira, her mother Sehrunissa, sister Sahira and brother Nasibullah pleaded not guilty to the perjury charge. After the Best Bakery re-trial, Mr. Thipsay had sent show cause notice under Section 344 of the Indian Penal Code (IPC) to Zahira and her family for giving false evidence. Their lawyer, Umesh Deshpande, said he intended to file a revision application in the High Court against the Best Bakery re- trial judgment. In an application to Mr. Thipsay, he said his client needed time to read the judgment and that it was necessary to see the entire material before the court during the re-trial. Mr. Deshpande asked for a month's time for filing his appeal and he sought an adjournment in the perjury case on this basis. He explained that the order had made certain adverse remarks against Zahira and others and he wanted to go in for a revision. However, Mr. Thipsay said that the proceedings under Section 344 of the IPC were summary proceedings. Already sufficient time had been given and even the particulars of the false statements made by Zahira and others had been explained to them. In such a situation, he said, the application for adjournment could not be entertained.
