Court orders re-autopsy in custodial death case

Dean of the Government Medical College will supervise the exercise

MADURAI : The Madurai Bench of the Madras High Court has ordered re-autopsy in a custodial death case in Tirunelveli district.

Admitting a petition moved by the brother of the deceased, Justice P. Murgesen directed the Superintendent of Police to exhume the body and conduct the necropsy at the burial ground itself, under the supervision of the Dean of the Government Medical College, Palayamkottai.

The court is closed for summer and the vacation Judge entertained the petition considering its urgency. Since the body was buried on May 3, medical experts had ruled out the possibility of preserving it after exhumation.

Theft case

According to the petitioner, C. Shivashanmuganathan, the then Munneerpallam police Inspector, S. Sathiyamoorthy, who was also in-charge of the Suthamalli police station, picked up his brother, C. Paramasivan, on May 2 in connection with a theft case.

The next day, the petitioner was informed that the detainee had hanged himself in the toilet attached to the lock-up.

The petitioner alleged that the police had concocted the story after killing his brother.

In his counter affidavit, the incumbent Inspector of police of Munneerpallam station, P. Jayakkodi, denied the allegations and claimed the accused was found hanging from the ventilator of the toilet on his `dhoti.'

The body was buried after post-mortem and there was no need for another autopsy.
