Forum directs DVD dealer to repay consumer

CONSUMERNOTES Defective appliance was neither replaced nor repaired

VISAKHAPATNAM: A DVD dealer in the city has been directed by the Visakhapatnam District Consumer Forum-II to repay a consumer the cost of the DVD with interest along with compensation and cost of litigation.

A resident of Adarshnagar at Thagarapuvalasa in the district, M. Prabhakar Rao, bought a DVD player for Rs. 6,000 from Stereo Vision in Dwarakanagar in July 2003. Within one-and-a-half months, the DVD player started giving trouble and functioned erratically. The consumer immediately informed the dealer who in turn gave it to Nahusha Electronics in the same locality for repairs. After repairs, it still gave trouble and the consumer again approached both the dealer and repairer and deposited the DVD for further repairs. Since then, the DVD player was neither repaired nor was its cost repaid even after a legal notice was issued.

Complaint filed

Later, the consumer filed a complaint (Consumer Dispute no: 617/05) against Stereo Vision (OP 1) and Nahusha Electronics (OP 2) in the Forum seeking repayment of the cost of DVD player with interest, compensation for mental agony, and costs of litigation.

The opposite parties denied that they were connected with each other and that the DVD player was sold without any warranty.

Forum president N. Sarojini Naidu and member G. Viswanadha Reddy, in their verdict noted that the OPs failed to rectify the defects or replace the defective DVD with a new one or repay its cost despite repeated demands by the consumer, which was deficiency in service.

In the result, the Forum directed the OP1 to repay Rs. 6,000 to the consumer within two months with 12 per cent interest from the date of purchase till the date of realisation.

It further awarded Rs. 5,000 as compensation for mental agony and Rs. 1,000 towards cost of litigation.
