BANGALORE: The Karnataka High Court, in an interim order, has stayed a notification by the Karnataka Information Commission, declaring Poornaprajna House Building Cooperative Society as a public authority.
Notification
The Karnataka Information Commission, in a notification on May 10, 2006, under the provisions of Section 19 (3) of the Right to Information Act, held that the society was a public authority. The Right to Information Act came into force on June 15, 2005, and the Karnataka Information Commission issued a notification on house building cooperative societies on September 22, 2005.
Appellate authority
The notification designated the chief executive officers (CEOs) of all cooperatives as public information officers and the presidents of cooperatives as the appellate authority. Justice N.K. Patil ordered issue of emergent notice to the respondents and granted interim stay of the notification by the KIC. He adjourned hearing of the case.
