Kochi: The Kerala High Court has admitted a writ petition challenging the order of the State Information Commission directing the Principal and manager of St. Xavier's College for Women, Aluva, to provide a candidate the mark-sheets of all participants of the interview conducted for the post of lecturers in Botany on October 20. . In their petition, the principal and the manager said the College was established and administered by the Congregation of Teresian Carmelites. The college had executed an agreement with the State Government for direct payment of salary to the staff. The admission, appointment and payment of salary of the staff were governed by the terms of the agreement. The college was not a statutory public authority as it was not a creature of any statute. In fact, the salary was being disbursed on the basis of the agreement. As a result of the agreement, the petitioner was making appointments of staff members as per the term of the agreement. The representatives of the State Government and Mahatma Gandhi University were essential for the constitution of the selection committee. The selection of teachers for the College was a procedure with the approval of the State and the University. In the event of any grievances, the aggrieved could appeal to the MGU Appellate Tribunal.
