NEW DELHI: The Supreme Court on Tuesday rejected underworld don Babloo Srivastava's plea for custodial parole to solemnise his marriage but allowed his petition, accusing the Centre of violating an extradition treaty, to be heard by the Delhi High Court. A vacation Bench comprising Justices Arijit Pasayat and Altamas Kabir remanded his petition back to the Delhi High Court accepting counsel's argument that in a matter in which two High Courts had jurisdiction, it could be heard as preferred by the petitioner.Babloo, who was extradited from Singapore in 1995, challenged the Delhi High Court's verdict transferring his petition, claiming Rs. 100-crore damages from the Centre for violation of the terms of the treaty, to the Allahabad High Court. He alleged that he was forced to stand trial in eight cases, which were not part of the treaty signed with Singapore while he was extradited. Instead of in four cases, Babloo was prosecuted in 12 cases in violation of the treaty terms, said counsel. As for custodial parole, Babloo moved the application for establishing a family link but during the hearing counsel orally pleaded that his plea be allowed for solemnising his marriage. However, the Bench said the court could not be a matchmaking agency.
