Minor girl files petition against parents

BANGALORE: A minor girl filed a petition in the Karnataka High Court on Tuesday against her parents, alleging that they had locked her up in a room and were compelling her to get married.

A Division Bench comprising Justice R. Gururajan and Justice Jawad Rahim adjourned hearing on the matter.

The girl, a resident of J.C. Nagar, alleged that her parents had locked her up in a room in their house, and they were forcing her to get married to a person of their choice. She said her elder sister had eloped, and her parents were worried she would also do so. The girl said she had filed the petition through her friend.

This is the second such case in the recent past of a girl filing a petition in the High Court against her parents.

In the earlier case, a girl from Sadashivanagar, who had run away from her parents' house, filed a petition seeking a direction to the police not to take her back.

She said she was unable to bear torture by her parents who wanted to her to get married.

Directed

The High Court on Tuesday directed the State Election Commission (SEC) not to issue the calendar of events for the elections to the Sindhanur Town Municipal Council (TMC).

A Division Bench, comprising Chief Justice Cyriac Joseph and Justice N. Kumar, passed the order while hearing a petition seeking to defer the elections until the delimitation process is complete.

The Bench adjourned hearing on the matter till Friday.

K.N. Phanindra, counsel for the SEC, said that as per the directions of the High Court, the Commission would not issue the calendar of events to city municipal councils, TMCs, corporation councils and town panchayats.

He said the SEC would await the decision of the court for proceeding with the elections.

Direction on polls

Elections to the Bangalore Advocates' Association will get under way with the High Court on Tuesday directing that they be held on or before August 31.

A Division Bench passed the order while hearing an appeal against the stay on the elections to the association.

The Bench observed that it was passing the order in view of the settlement to resolve the problem amicably "within the family''.

It came up with guidelines on the conduct of the elections, and said it would set up a three-member committee headed by the Advocate-General and two senior counsel to supervise the elections.

The association general secretary was directed to hand over the voters' list to the committee within a fortnight. The Bench said a week's time would be given to the advocates to file their objections

While directing the association to issue a fresh calendar of events, the Bench said A.G. Shivanna would continue to be the returning officer. It said members enrolled after September 24, 2005 would not be entitled to vote. The Bench directed the general secretary to submit to the committee the names of members.

Order quashed

The High Court on Tuesday quashed a lower court order which had granted bail to a person subject to the condition that he deposit half the amount he allegedly misappropriated. Justice B. S. Patil observed that the District and Sessions Court ought not to have imposed such a condition.

A deputy manager in the State Bank of Mysore, Haveri, was arrested on the charge of misappropriation. As the joint custodian of the currency chest, he had to ensure that cash was received intact. However, on inquiry, it was found that Rs. 65 lakh was missing.

Former State Public Prosecutor H.S. Chandramouli informed the court that the Sessions Court had granted bail to the deputy manager subject to the condition. Mr. Chandramouli said the objective of bail would be lost, and the Sessions Court ought not to have behaved like a recovery court.

Justice Patil, who setting aside the condition, ordered the release of the deputy manager on bail.
