Court reserves order on Sahil's bail plea

Staff Reporter

Application for narco-analysis will also be heard on Monday

  • No parity between Rahul, Sahil: prosecution
  • Nothing against my client: Sahil's counsel

NEW DELHI: A special court here on Friday reserved till Monday orders on a bail application by Sahil Zaroo, co-accused with Rahul Mahajan in a drug abuse case.

On the prosecution plea for permission to conduct narco-analysis and brain mapping on Rahul Mahajan, son of slain BJP leader Pramod Mahajan, and Sahil, Special Judge S.N. Gupta said he would hear the applications immediately after passing the order on the bail petition.

Opposing the bail application, public prosecutor B.S. Joon said there was no parity between the two accused. Sahil was a "habitual offender," while Rahul Mahajan's antecedents were clean. A criminal case for violation of the Wildlife Act had been pending against Sahil in a Mumbai court.

After the June 2 incident at 7, Safdarjung Road here, Sahil got himself treated for drug consumption in a hospital here, giving a wrong address, and then he fled to Srinagar with the drug, Mr. Joon said.

He submitted a printout of the record of calls made by Sahil from his mobile to Nigerian national Abdullah, the alleged drug supplier. Sahil purchased drugs from Abdullah and made supplies to addicts earlier as well, Mr. Joon said.

Sahil's counsel pointed out that Special Judge Swarna Kanta Mehra, while granting bail to Mr. Mahajan, said the police were not yet able to make a case of financing of drug trafficking and harbouring of drug dealers against him. And if at all a case was made out against Sahil, it was for drug consumption, which is a bailable offence, counsel said.

Except for Sahil's disclosure statement, there was nothing with the police against his client, counsel said.
