Directive to BDA

The Karnataka High Court has taken serious exception to the manner in which the Bangalore Development Authority (BDA) cancelled a site it had allotted to a woman and directed the agency to produce within two weeks the list of allotments made to Union Government employees.
K.S. Nirmala Devi, a Union Government employee, had applied for a site with the BDA. On February 7, 2004, she was allotted one in Sir M. Visvesvaraya Layout. However, after the BDA completed the formation of the layout, she realised that a storm water drain had come up on the site allotted to her. She then applied for an alternate site. The BDA granted her the site. The petitioner said she was shocked when the BDA issued a show-cause notice to her, asking her why the site allotted to her should not be cancelled.The BDA contended that she had made only three attempts and as per the rules a minimum of four attempts had to be made. It was also stated that this rule was in force under Category-6, which is classified only for Union Government employees. The BDA also told her that initially they had not realised the same in her case, but on verification it had come to light. The site was cancelled on December 1, 2005. She then moved the High Court. Justice Manjula Chellur adjourned further hearing on the case.
