BANGALORE: The Karnataka High Court on Wednesday quashed a Government Order of June 12, 2006 withdrawing all the provisional allotment of in-service candidates from the Department of Health and Family Welfare for admission to PG degree and diploma courses in medicine and dentistry for 2006-07. The GO had also ordered for recounselling of such candidates for the postgraduate common entrance test (PGCET) 2006. The petitioners, Dr. Mahesh and four others, had challenged the GO, saying that the withdrawal of allotment had come as a shock to several doctors who had already gained admission in colleges for degree and diploma courses under the in-service quota. The petitioners said the classes had already commenced and the cancellation of the in-service list had come as a bolt from the blue for them as they were not given any prior intimation or advice on the issue. The GO said the order for recounselling of seats for in-service candidates was made under Rule 19 (5) of the Karnataka Conduct of Entrance Test for Admission to Postgraduate Medical and Dental Degree and Diploma Courses, Rule 2003. It said there was some discrepancy in the rank list of in-service candidates selected and prepared by the Department of Health and Family Welfare and sent to the Selection Committee of the PGCET 2006. Allowing the petitions, Justice D.V. Shylendra Kumar observed that the allotment of seats should not have been cancelled in the absence of rules. He directed the authorities to restore the counselling for in-service candidates from the date of cancellation.
