Court directive to Delhi University on physically challenged candidate

The directions were passed on a petition filed by the candidate

NEW DELHI: The Delhi High Court has directed the Delhi University to consider granting provisional admission to a physically challenged candidate who alleged that the varsity was not allowing him to join its dental course despite his qualifying in an entrance test.

Vacation Judge A K Sikri ruled that the candidate should not be denied admission only on the ground that the University wants to fill two seats as against the 12 seats reserved for physically challenged candidates.

The directions were passed on a petition filed by the candidate, who said that he had passed the Delhi University Medical Dental Entrance Test held on May 22, 2006, but was still being denied admission.

The candiate argued that though there are 12 seats reserved for physically challenged candidates, the University had decided to fill only two seats and as a result, he was being denied admission.

He further alleged that the University, instead of providing any proper explanation for denying admission, merely informed him orally that his case was not considered as he was ``medically unfit''.

The petitioner complained that the University neither conducted any medical test on him nor disclosed the basis on which such an opinion was formed.

He contended that the actual intention behind the denial of admission was that the University wanted to fill up only two seats as against the 12 reserved seats.-PTI
