Court notice to Nitish Kumar
Legal Correspondent
New Delhi:
The Supreme Court on Monday issued notice to Bihar Chief Minister Nitish Kumar, State Chief Secretary and nine State Vigilance Bureau officials on a petition filed by the former Bihar Public Service Commission (BPSC) chairman, Ram Singhasan Singh, challenging his removal.
A vacation Bench comprising Justice A.R. Lakshmanan and Justice Altamas Kabir, while issuing notice, made it clear that it was confined only to the limited question on the validity of the observations made by the Patna High Court that there was no mala fide intention in the action of the Chief Minister and other respondents in his removal on alleged charges of forgery and corruption in the selection of candidates in the Bihar Administrative Service Examination held in 2003.
The petitioner alleged that the Chief Minister had contravened Article 317 (2) of the Constitution (procedure for removal of the Chairman or member of the Public Service Commission).
