New Delhi: The Supreme Court on Monday permitted the Centre to file a special leave petition against the Allahabad High Court ruling cancelling the orders of the Uttar Pradesh Raj Bhavan Secretariat on the appointment of an additional legal adviser to Governor T.V. Rajeshwar. A vacation Bench comprising Justices A.R. Lakshmanan and Altamas Kabir said the issue seemed to be a "clash of ego." The matter is listed for hearing on Tuesday. The High Court ordered the transfer of additional legal adviser Pradeep Dubey out of the Raj Bhavan. When this order was not complied with, the court placed him under suspension. Mr. Rajeshwar sent a letter to the court stating it was mandatory to seek the Governor's concurrence on the appointment and transfer of officials posted in the Raj Bhavan. The State Government, complying with the court order, appointed Vijay Verma additional legal adviser. However, he could not assume charge as the Governor declined to relieve Mr. Dubey. On June 23, the Full Bench directed Mr. Dubey to take charge as additional district judge (under suspension) in Ballia and listed the matter for July 4. The Centre sought permission to file the SLP against this order.
