BANGALORE: The Karnataka High Court on Friday rejected a petition by the daughter of a former court employee, seeking employment on compassionate grounds. The petitioner, Chayadevi, said her father Munikrishna was employed as a Second Division Clerk in the High Court. He died on April 13, 1999, while still in service. He had two wives and Chayadevi was his daughter from the first wife, Sundaramma. When he married again, Sundaramma filed a petition for maintenance. While she was awarded Rs. 300 a month, Chayadevi was given Rs. 150 a month. When Munikrishna died, Chayadevi was still a minor. She applied to the High Court for a job on compassionate grounds when she became a major in 2000. Dismissing her petition, a Division Bench comprising Justice B. Padmaraj and Justice S. Abdul Nazeer said the application for appointment was sent to the High Court after the time limit prescribed in the rules for making such appointments. While Munikrishna died in 1999, the application for employment was made on November 4, 2000. The Bench said appointments on compassionate grounds had to be made in accordance with the rules, regulations and administrative instructions. It said appointments on compassionate grounds should be provided immediately to redress the problems of a family in distress. The fact that the ward was a minor at the time of the death of a parent was no ground, unless the scheme specified it. Dismissing the petition, the Bench said the order would not come in the way of appointment on compassionate grounds, if the court wanted to do so.
