Further probe ordered into Kiliroor sex racket case

CBI conducted only a formal investigation, says Magistrate

Kochi: Ernakulam Chief Judicial Magistrate P.D. Sarangadharan has directed the Central Bureau of Investigation (CBI) to conduct further investigation in the Kiliroor sex racket case. The directive was given while passing orders on the final report filed by the CBI.

The magistrate said it could be seen that the CBI had conducted only a "formal investigation."

"There was no earnest attempt on the part of the investigation officers to find the truth."

The Magistrate said the CBI report revealed that the quantity of copper in the blood of the victim (Shari) was excessive. Doctors had not given any satisfactory reason or explanation in this regard. The board of doctors constituted by the CBI had expressed the opinion that they had not come across such high level of ionic copper in blood and that they had not been able to give any conclusion about its cause and effect.

It was important to note that according to the investigation officers and the doctors who treated the victim and also the medical board had opined that the treatment given to the victim was the best treatment available.The court said since this was a case in which the victim had died while the probe was on and there were widespread allegations about her death, the officer should have conducted investigations on these aspects.

The court also pointed out that the report filed by the investigation officer revealed that the victim was discharged from Kottayam Medical College Hospital on August 28, 2004. The board of doctors had expressed the opinion that further evaluation should have been initiated in view of her medical condition and that her discharge from hospital appeared to be premature.

The court pointed out there was a conflicting statement about the visits of the victim along with others at Alappuzha resorts. The investigation officer had not thoroughly investigated these aspects. The Magistrate dismissed a petition filed by Janathipathya Vanitha Sanghtanan seeking further probe.
