Njeliyanparamba issue: court decision today

Plea to restrain civic body from upgrading treatment plant


  • `Corporation has no right to pollute air and water'
  • Plea to stop dumping or storing of waste at the site
  • `Stop discharge of leachate, wastewater into public drainage

    Kozhikode: The Kozhikode Additional Sub Court (III) Judge R.R. Kamath will take a decision on Wednesday on a petition filed by the Council for Environment Conservation seeking permanent solution to the garbage problem at Njeliyanparamba on the outskirts of the city.

    The Court on Tuesday admitted a petition, also filed by the council, seeking to implead the Kerala State Pollution Control Board in the petition. Already it had heard the respondents, representing the District Administration, Kozhikode Corporation Secretary, Nallalam-Cheruvannur grama panchayat Secretary and Calicut Development Authority (CDA).

    The petition filed by B. Ashraf, Malazhy Sahadevan and O. Koya, through Retna Kumar Mallissery on June 29, pleaded that the Court pass a decree of declaration that the Kozhikode Corporation had no right, power or authority to act in any manner that would create air and water pollution in the residential area of Njeliyanparamba.

    The plaintiffs also wanted the Court to issue an injunction restraining the District Administration and Corporation from dumping or storing waste of any sort at Njeliyanparamba. They also wanted removal of the entire pre-process and post-process waste rejects and untreated old waste piled at the dumping grounds.

    Injunction sought

    Another plea stated in the petition was to order a mandatory injunction directing the District Administration, Corporation and CDA to identify and set up a land fill site in accordance with the norms and specifications as laid down by the Municipal Solid Waste (Management and Handling Rule 2000) with immediate effect.

    The complainants also prayed to pass a permanent prohibitory injunction restraining the respondents from upgrading the existing waste treatment plant or installing a new one at Njeliyanparamba.

    It also wanted the Corporation to stop the functioning of the treatment plant until it gets a valid licence from the Nallalam - Cheruvannur grama panchyat. The petition also sought to restrain the Corporation from discharging leachate and wastewater from Njeliyanparamba into public drainage, lanes of residential areas and public places.
