NEW DELHI: The Delhi Government on Friday informed the Supreme Court that it had sought Interpol assistance to secure Bharti Yadav, main witness in the Nitish Katara murder case. Nitish Katara, who was allegedly having an affair with Bharti Yadav, was murdered in Ghaziabad. Despite repeated orders passed by the trial court and issue of summons, Bharti Yadav, reportedly in the United Kingdom, failed to appear to give evidence, Additional Solicitor-General Gopal Subramaniam told a Bench consisting of Justices K.G. Balakrishnan and D.K. Jain. The trial court had reserved orders on the plea that she be declared a proclaimed offender. Ms. Bharti's father said he was unaware of his daughter's address in London. Apart from sending a letter to Interpol on July, the Delhi Government was taking up the matter with the British Government. Mr. Subramaniam pleaded that the High Court order granting bail to Vishal Yadav, one of the accused, be quashed. The Bench was hearing petitions filed by the Delhi police and the victim's mother, Nilam Katara, against the October 2005 bail order. Vishal's cousin Vikas Yadav, a co-accused, is still in jail. The Bench said: "It is strange that a father does not know where his daughter is." Taking exception to the manner in which the case unfolded, it said: "If you are taking the judicial system for a ride, then we will have to take into consideration the totality of circumstances and lay down parameters for cancellation of bail. We can't shut our eyes to ground realities." The case is posted for hearing after two weeks.
