Kerala High Court's interim order likely today

KOCHI: The Division Bench of the Kerala High Court, which heard the arguments pertaining to the appeals filed by the Government and others on the self-financing colleges issue, is expected to give an interim order on Saturday afternoon. The appeals challenge a Single Judge's order on the Kerala Professional Colleges (Prohibition of Capitation Fee, Regulation of Admission, Fixation of Non-exploitative Fee and Other Measures to Ensure Quality and Excellence in Professional Education) Act, 2006. The Single Judge had ordered status quo for the current academic year with regard to the fee structure and various quotas despite the Assembly passing the new law.

Counsels for the managements and the Government concluded their two-day arguments before the Division Bench of Chief Justice V. K. Bali and Justice M. Ramachandran on Friday. On the question whether the State could take over the examination process for admission in case of malpractice on the part of private college managements, counsel for the managements contended that the State could exercise control over the admission process, but could not take over the test procedure as a whole. The progress of a country depended on the quality of its human resource. The private college managements were engaged in promoting excellence. Even at the primary and secondary levels, some of the excellent schools in the State were in the private sector.

Counsel's contention

Though the entrance examination conducted by a consortium of private self-financing colleges was challenged in the Supreme Court in 2003, the apex court did not find fault with it. Counsel said the admission procedure adopted by the private colleges guaranteed merit. The selection process was transparent.
