Poll petition: fiat to High Court

Staff Correspondent

Bidar: The Supreme Court has restrained the High Court from ruling on the petition challenging the election of Bhalki MLA Prakash Khandre till it decides on the matter.

Prakash Khandre told presspersons in Bhalki on Sunday that this acted as a stay on several petitions filed by his cousin and political rival Ishwar Khandre challenging his election to the Assembly in 2004.

Mr. Ishwar Khandre had challenged Mr. Prakash Khandre's election, alleging that the latter was a contractor and, therefore, held an office of profit. "I have filed a petition in the Supreme Court, seeking a direction to the lower courts not to entertain multiple election petitions, as fighting them would take away most of a legislator's time. I also requested the Supreme Court to remind the petitioners not to file petitions on a matter that was already pending in the court," Mr. Prakash Khandre said.

In 2005, the Supreme Court had issued an interim order setting aside Mr. Ishwar Khandre's petition challenging Mr. Prakash Khandre's election.
